This website and associated platform (“the site”) are owned and run by Zaihou Pty Ltd ABN 65110629457 (“the Business”). By accessing the site, you accept the terms and conditions set out below (“terms”) and agree to use the site in accordance with all applicable laws. If you are not agreeable to the terms, you should cease to use the site. The Business reserves its right to change the terms at any time, so please be mindful to check from time to time, as continuing to use the service will be considered acceptance of any changes made.

1.Use of the site

1.1 Any download, installation, access, or use of the site is at your own risk and cost. Any information supplied is on an as is basis and excludes any warranties which may be excluded by law.
1.2 All logos and material on the site are the Business’s property.
1.3 The site will not be used for spam or commercial purposes.
1.4 The site must not be decompiled, reverse engineered or disassembled.
1.5 Your use or right to access the site may be suspended or disabled at any time and for any reason.

3.Governing law

3.1 The law of Queensland, Australia, governs these terms and you submit to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia.

4.Alcohol Terms and Conditions

4.1 The Responsible Service of Alcohol is supported by the Business. Therefore, the Business reserves the right in our absolute discretion to cancel or decline any order, if the order is reasonably believed to breach the applicable laws and regulations in relation to the sale and supply of liquor and/or the terms of the Licence.
4.2 If you as the customer, look under 25 years old and do not show proof of age by way of valid photo identification, the whole or part of the order will be declined or cancelled. If at the time of delivery, anyone present at the premises looks under 25 years old and/or shows signs of intoxication and does not show proof of age by way of valid photo identification, the whole or part of the order will be declined or cancelled.
4.3 Regardless of any reason, liquor will not be delivered and left unoccupied at the premises.
4.4 Under the Liquor Act 1992 and Wine Industry Act 1994 (QLD), it is an offence to;
– supply liquor to a person under the age of 18 years;
– for a person under the age of 18 years to purchase or receive liquor.

4.5 Alcohol must be ordered with food, will not be available after 10pm and only less than 2.5 litres of alcohol will be sold in one food order.

5.Information on the Site

5.1 Information published about a product on the site does not reflect its availability.
5.2 All products are advertised subject to availability.
5.3 Pricing is subject to change without notice and the Business does not undertake to keep the site updated.
5.4 If any error occurs due to the information on the site being out of date, the Business will not be held liable.

6.Changes and Cancellations

6.1 You are permitted to cancel or change your order at any time up to 30 minutes minutes before the Pickup time, by contacting the restaurant directly at your ordered store. No cancellations or changes will be accepted by the Business within 30 minutes prior to the Pickup Time. If this occurs, the payment will still be processed, and the Business will then determine if a refund is applicable in your situation.

6.2 If we, the Business, are unable to fulfill the order due to the product being unavailable or any other unforeseen circumstance, you may be contacted to change or cancel the order. In such a case, we will determine whether it is appropriate to replace the item, provide a partial or complete refund or provide another form of compensation we deem appropriate.

7.Refund Policy

7.1 Orders must be checked upon pick it up at Hakataya store and any complaints must be submitted to info@hakataya.com.au for consideration within 24 hours after the items picked up at Hakataya store. The complaint will then be reviewed, and you will be contacted by our team.
7.2 Any decision to allow a refund will be at our discretion and subject to any legal obligations. No refunds or exchanges will be permitted on any order due to change of mind.
7.3 The Business will not be liable for delays in the order being delivered for any reason and any loss or damage as a result of the packaging or unloading of the order.

8.Disclaimers

8.1 The Business excludes all liability for any damage or loss you may sustain as a result of the use of the site or any online ordering platform (e.g. if you buy goods from a delivery company such as Uber Eats), to the extent permitted by law. This does not include damage or loss caused by our omissions or wilful act.
8.2 These terms only apply to the extent permitted by law and shall not be construed as qualifying, limiting or exclude your statutory rights or remedies in any way.
